Please find below the terms and conditions for ThinkBuzan training services which act as a legally binding agreement between OpenGenius Ltd and our customers. Upon your part or full payment for the course, you are agreeing to these terms and conditions. Please note that the Terms & Conditions below are subject to change.
At the time of booking, the purchaser is required to pay a 10% non-refundable deposit as soon as possible in order to secure their place, the remaining balance will then be due 30 days before the course start date in order to fully confirm their place. If the booking is made less than 30 days before the course start date, the payment for the course must be made at the time of booking in full. OpenGenius Ltd will not accept any delegates on any courses unless full payment has been received prior to the start of the course.
Bookings and payments must be made directly through OpenGenius Ltd and not booked via a third party individual. For group bookings, OpenGenius Ltd must be provided with the full names, contact information and billing details for each delegate for our records. OpenGenius Ltd reserves the right to contact each course delegate to verify the group booking. For group bookings, only one person within the group will be invoiced for the full amount of all attendees and ThinkBuzan will require the payment to be made in full for all delegates in one transaction.
Please note, any course fee payments made to OpenGenius Ltd may be subject to bank charges which the delegate is required to cover before attending the course.
For group bookings, this will only be available to employees who work for the same company. At the time of booking, the attendee must provide ThinkBuzan with a letter from management on headed business paper in order to confirm that the group of attendees are in fact part of the same business.
We understand that, due to unforeseen circumstances, attendees may have to alter their arrangements. In these cases every effort will be made to accommodate the change, although this cannot be guaranteed. If you are unable to attend for any reason, you must notify us in writing as soon as possible before the start of the course. If we do not hear from you once the course has started, we will assume that you have cancelled and you will not be able to transfer to another course or be entitled to a refund.
If you have paid in full, and wish to transfer to a later course date, as long as we are able to re-sell your original place, we will be happy to offer you a non-refundable credit that you may use for any future OpenGenius Ltd dates for that course which is within 12 months of your original course date, subject to availability. The credit cannot be used in conjunction with any other offers and can only be used on the course discipline which you initially paid to attend.
If you have paid a deposit, and you wish to re-book onto the same course at a later date, as long as you make full payment 30 days before the next course that you choose to book onto, and this course is within 12 months from the original start date, you will be able to transfer.
In both of these cases, a fee of £100 (plus tax if applicable) will be charged to transfer from one course to another to cover the administration costs. This fee will be payable to OpenGenius Ltd. In order to transfer your place we would require this amount to be paid upon your notification to OpenGenius Ltd of your intention to transfer your place. Please note you will only be able to transfer to another course if space is available.
For bookings made through our website, there is a 7 day ‘cooling off’ period. This cooling off period lasts seven (7) working days from the date which payment was made to OpenGenius Ltd. Therefore, if you request a refund for any reason in writing from OpenGenius Ltd during this period, OpenGenius Ltd will provide you with a refund for the total amount, paid within 30 days. Refunds shall be made by the payment method which you used to make payment to OpenGenius Ltd. If you request a refund, you are obligated to cover any transaction charges which may occur as a result. Please note, OpenGenius Ltd reserves the right to refuse a refund if the refund is requested within 7 working days of the start of the course.
If you have paid a deposit or paid in full, and do not wish to re-book onto the course at a later date, then you will lose the course fees paid to OpenGenius Ltd. Please note, all requests for transfers and refunds must be made in writing and acknowledged by OpenGenius Ltd. However, please be aware that places booked at a discounted price are non-refundable and non-transferable.
If you are unable to attend the course which you have paid for, you are permitted to substitute your place with a nominated individual. If your nominated individual wishes to pay for the course his/herself, we will refund your amount once we have received full payment from your nominated individual.
Due to unforeseen circumstances that may be out of OpenGenius Ltd’s control, it may be necessary to change or cancel course dates, content, venues and prices from those published. We will make every effort to transfer your booking, together with any payment made, to the next available course at your preferred venue. It should be noted that we will not be held liable for any costs or losses incurred by you as a result of any such changes, including travel arrangements and accommodation. OpenGenius Ltd also reserves the right to change the trainers at the course. Should this happen, OpenGenius Ltd will notify you at the earliest convenience and OpenGenius Ltd is not obligated to provide you with a refund or any monetary compensation in this case.
The parties shall treat as and keep confidential all information whether of a technical, commercial or any other nature relating to the other party and shall not, at any time, divulge any such information to any person not authorised by the divulging party to receive it and shall not utilise any secret or confidential knowledge or information acquired in connection with this Agreement to the detriment or prejudice of the other party or use the same for any purposes save for the purposes of this Agreement.
The attendee shall ensure that it has in place all necessary consents in connection with Personal Data to allow OpenGenius Ltd at all times to perform the Training Services without infringing any third party rights. OpenGenius Ltd warrants to the Client that it will only use the Personal Data for the purpose of carrying out its obligations hereunder and that it will ensure that all reasonable and appropriate security measures are in place to protect the Personal Data and that it will destroy or deliver the Personal Data upon written demand from the Client, and further, that it has in all respects complied with its obligations under the Data Protection Act 1998 (UK) and any amendments to or re-enactments thereof.
On occasion during the course, some filming or photography may take place. The video footage or photographs are captured by members of the ThinkBuzan team and used only by the ThinkBuzan team to promote the course to future delegates. If you partake in any filming or photographs you will be providing your consent to the release of your image, likeness and the sound of your voice. You will also be agreeing that the footage may be edited and used by OpenGenius Ltd, in whole or in part, in all media, including, but not limited to, audio and video cassettes, CD-ROM, DVD, Internet, television, radio and cable broadcast, and for all other purposes in perpetuity throughout the world. If you do not wish to be involved, please could you inform us in advance of the course if possible and also on the first day of the course.
OpenGenius Ltd currently has a referral scheme in place which is exclusively available to all active ThinkBuzan Licensed Instructors (TLI) in Mind Mapping, Speed Reading and Memory Skills. The scheme works on the basis that for every delegate who attends a ThinkBuzan Licensed Instructor course as a result of the TLI’s referral, the TLI will receive a 10% commission of the total amount received by OpenGenius Ltd. If the TLI refers a Practitioner whom the TLI has trained, the TLI shall receive 10% commission and the Practitioner, a 5% discount. The referred individual must include the name of the TLI in the online booking form and must state that they are a Practitioner via the iMindMap website or the TLI must notify ThinkBuzan in writing prior to the booking and must state that the referred individual is a Practitioner (if applicable). TBL will not apply commission or refunds under any circumstances if notified after the booking is made.
The commission the referrer will receive is 10% of what the delegates pay for their space on the course, less any bank charges or additional credit card fees. This will be paid to the referrer in GBP £ Sterling via paypal only, 30 days after course completion.
